Waiver and Release Form

In consideration of my use of the exercise equipment and facilities provided by Silanoe Martial Arts LLC, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the company and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, or my guest in, on, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of Silanoe Martial Arts LLC and, or any of its associates. 

By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and I hereby fully and forever release and discharge the company, its insurers, employees, directors, contractors, and associates, from any and all claims, demands, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment and facilities.

I expressly agree to indemnify and hold Silanoe Martial Arts LLC harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me or my guest.

I agree to be solely responsible for the safety and well-being of my guest and myself. I understand that Silanoe Martial Arts LLC does not provide supervision, instruction, or assistance for the use of the facilities and equipment. 

I agree to comply with all the rules imposed by Silanoe Martial Arts LLC regarding the use of the facilities and equipment. I agree to conduct myself in a controlled and reasonable manner at all times and to refrain from using any equipment in a manner inconsistent with its intended design and purpose. 

I understand and acknowledge that the use of exercise equipment involves risk of serious injury, including permanent disability and death.

I understand and agree that Silanoe Martial Arts LLC is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises. 

I acknowledge that I have carefully read this 'waiver and release' and fully understand that it is a release of liability. I expressly agree to release and discharge the trainer or instructor from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against the trainer, instructor, and/or Silanoe Martial Arts LLC for personal injury or property damage. 

Furthermore, I understand that all SIlanoe Martial Arts LLC's services are non-refundable and non-transferable and have noted the expiration period for such services

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19I

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization.  Silanoe Martial Arts, LLC has put in place preventative measures to reduce the spread of COVID-19; however, Silanoe Martial Arts, LLC cannot guarantee that you or your family will not become infected with COVID-19. Further, attending our academy could increase your risk and your family’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my family and I may be exposed to or infected by COVID-19 by attending Silanoe Martial Arts, LLC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Silanoe Martial Arts, LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Silanoe Martial Arts, LLC employees, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my family or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my family may experience or incur in connection with my or my family’s attendance at Silanoe Martial Arts, LLC or participation in Silanoe Martial Arts, LLC programming (“Claims”). On my behalf, and on behalf of my family, I hereby release, covenant not to sue, discharge, and hold harmless Silanoe Martial Arts, LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Silanoe Martial Arts, LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Silanoe Martial Arts program.

SILANOE MARTIAL ARTS LLC PHOTO RELEASE FORM

 I hereby grant Silanoe Martial Arts LLC permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

 I understand and agree that all photos will become the property of Silanoe Martial Arts LLC and will not be returned.

I hereby irrevocably authorize Silanoe Martial Arts LLC to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose.  In addition, I waive any right to inspect or approve the finished product wherein my likeness appears.  Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

 I hereby hold harmless, release, and forever discharge Silanoe Martial Arts LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I have read and understood the above photo release. I affirm that I am at least 18 years of age, or, if I am under 18 years of age, I have required consent of my parents/guardians as evidenced by their signatures below.

By signing this waiver and release, I acknowledge that I understand its content and that this release cannot be modified orally.
